Terms of service

These terms govern your use of venerabull.com and any order you place through it. By using the site or placing an order you agree to them. The site is operated by Venerabull LLC, a New York limited liability company.

Orders

An order placed on this site is an offer to buy. It becomes a contract when we confirm acceptance in writing, not when the site takes your details. We may decline an order — for example where an item is unavailable, where a price or specification was published in error, where we cannot deliver to the address, or where we suspect fraud. If we decline after you have paid, we refund you in full.

Prices and errors

Prices are in US dollars and exclude sales tax, which is calculated at checkout where applicable. We work carefully, and we still make mistakes. Where a price, specification or availability is wrong, we may correct it and give you the choice of proceeding at the corrected terms or cancelling for a full refund. We will not quietly ship you something other than what you agreed to buy.

Descriptions and specifications

Product information, including anything our assistant tells you, is provided in good faith and is general to a category unless it is quoted from a specific manufacturer's documentation. The manufacturer's published specification is the only figure to build to. Confirm dimensions, clearances, structural requirements and electrical requirements against the manufacturer's documentation before you commit to construction, wiring or installation. Where our information and a manufacturer's sheet disagree, the sheet governs.

Delivery

Delivery is governed by our shipping policy, which forms part of these terms. Lead times are estimates confirmed in writing after your order and are not guaranteed dates. Title and risk of loss pass on delivery.

Returns

Returns and cancellations are governed by our refund policy, which forms part of these terms.

Warranties

Goods sold here carry the manufacturer's warranty, and that warranty's terms and duration are set by the manufacturer, not by us. We will open and pursue a warranty matter with the manufacturer on your behalf. Except for the manufacturer's warranty and any rights you have under law that cannot be excluded, goods are supplied without further warranty from us, and we disclaim implied warranties of merchantability and fitness for a particular purpose to the extent the law allows.

Installation and site work

Unless we have agreed it in writing as part of your order, installation, electrical connection, plumbing, structural work and permitting are yours to arrange. Much of it is regulated work. We are not responsible for the work of a contractor you engage, or for loss arising from installation that does not follow the manufacturer's instructions or applicable code.

Your account

If you create an account, you are responsible for your credentials and for activity under your account. Tell us promptly if you believe it has been used without your permission.

Acceptable use

Do not use this site to break the law, to interfere with its operation or security, to scrape it at a scale that degrades it for others, or to resell our content as your own. We may suspend access where any of that occurs.

Our content

The design, text, software and assistant on this site are ours or our licensors'. Manufacturer photography and specifications remain the property of their owners and are used with permission. You may not copy or reuse any of it commercially without written permission.

Limitation of liability

To the fullest extent the law allows, Venerabull LLC is not liable for indirect, incidental, special or consequential loss, including lost profits, lost time, or the cost of construction, contractors or site work undertaken in reliance on information from this site. Our total liability arising out of any order is limited to the amount you paid for the item that gave rise to the claim. Nothing in these terms limits liability that cannot be limited by law.

Indemnity

You agree to indemnify Venerabull LLC against claims arising from your misuse of the site or your breach of these terms.

Governing law and disputes

These terms are governed by the laws of the State of New York, without regard to its conflict-of-laws rules. Any dispute will be brought in the state or federal courts located in New York, and both of us consent to that jurisdiction. Before filing anything, contact us — most disputes end with a phone call.

Severability and entire agreement

If any provision is found unenforceable, the rest stands. These terms, together with the shipping, refund and privacy policies, are the entire agreement between us regarding your use of this site and supersede earlier discussions.

Changes

We may update these terms. The version in force for your order is the version published when your order was accepted.
